Purchase conditions:

 These Terms & Conditions apply to you as the school, educational setting, educator.

Terms & Conditions

These Terms and Conditions form the Agreement between trading as The SEND Academy and the person/organisation who has purchased. Resources are purchased and an Agreement is made once payment has been received. 

These Terms and Conditions shall have priority and take precedence over any other agreement and/or terms and conditions whether provided by you, your organisation, or any third party. 

Resources

You will not be entitled, nor entitled to, unless you are deemed to be so by an authorised representative of The SEND Academy to claim resources as your own or share to any other setting under copyright law, with all rights reserved at The SEND Academy.

Teaching

You may deliver the activities within your setting to support children’s emotional development. The Contents may only be used under the branding of The SEND Academy and The SEND Academy logo.

You undertake: 

to only use the Contents under The SEND Academy for the purpose of delivering sessions within your setting; 

not to do anything to damage the reputation of The SEND Academy;

not to hold yourself out as a representative of The SEND Academy; 

not to use a name identical and/or like the name The SEND Academy; 

not to apply to register a trademark like The SEND Academy

Intellectual Property Rights  

All intellectual property rights and other rights (including without limitation know-how, copyright, database rights, trademarks and designs, whether registered or unregistered) (together “the Rights”) in and to the resources and its contents (which for the avoidance of doubt shall include without limitation all materials, commentary and information provided for, contained in or available from the resources) (together “the Contents”) are owned by The SEND Academy. 

 You acknowledge that all Rights in the Contents are owned by The SEND Academy;

to the extent that they do not vest automatically, you hereby assign all such past, present and future Rights to The SEND Academy. You shall not knowingly do anything which adversely affects such Rights.  For the avoidance of doubt and without limitation, you must not: 

exploit, use or disclose any part of the Contents for any purpose other than for purposes in accordance with this Agreement;

alter, adapt, or amend the Contents except as permitted by law; 

reproduce, copy or deal in the Contents (in whole or in part) in any way unless agreed in writing by The SEND Academy. 

 The Contents and the Rights are granted to The SEND Academy all rights reserved.

It is not the responsibility of The SEND Academy to ensure health and safety, and safeguarding regulations are in place. We as a resource provider are responsible for sharing ideas, however it is at the professional judgement of the educator to ensure that children and young people are safe.
